Meta changes Facebook and Instagram's terms of service in Europe

Starting Wednesday, Meta (Facebook, Instagram, WhatsApp) will change its terms of use to allow it to continue collecting and processing the personal data of its European users.

Meta will therefore modify its terms of list of mobile number database and its privacy policy for the European Union by changing the "legal basis" which it uses to justify its use of personal data.

The group will now rely on "legitimate interest," a legal concept used by companies when the personal data processing they implement does not significantly harm the rights and interests of the data subjects. Currently, the group relies on a contract entered into with the user when they register on the social network.

390 million euros in fines

This announcement comes three months after Meta was fined two companies totaling €390 million for breaching the EU General Data Protection Regulation (GDPR). The Irish Data Protection Commission (DPC), the regulator acting on behalf of the EU, stated at the time that Meta had breached its transparency obligations and relied on an incorrect legal basis for its processing of personal data for targeted advertising.
