The bill on amendments to the Russian Federation Law "On the Protection of Consumer Rights" was introduced by State Duma deputies and Russian senators. In order for RuStore to appear in the Apple store, the company must agree to comply with the new legislation. The law does not directly say what will happen if it refuses to comply. Dmitry Kirillov, an adviser to the Lidings law firm and a teacher at Moscow Digital School, explained that for the sale of certain types of technically complex goods without the ability to use Russian programs, according to Part 6 of Article 14.8 of the Code of Administrative Offenses of the Russian Federation, officials are subject to an administrative fine of 30,000 to 50,000 rubles, and for legal entities - from 50,000 to 200,000 rubles.
"In addition to this, it will be possible to apply the entire range of penalties in favor of the consumer - the recovery of losses, moral damages, penalties and fines on the basis of the Law on the Protection of Consumer Rights," added Dmitry Kirillov.
Pavel Katkov, founder of the law firm Future Legal, does not believe that the company will comply with the new legislation: in his opinion, Apple will either speak out against it or remain silent. The lawyer believes that in this case, the devices may be restricted from sale in retail chains, since their sale without RuStore will be contrary to the law.
"It is also likely that Apple will remain silent, since it is a US company. Under sanctions, it will be strange that they are defending the right to sell products on Russian territory. They are unlikely to directly enforce the law for the same reason. In any case, the position of their products on the Russian market will no longer be the same," the lawyer believes.
Back in March 2022, Apple announced that it would stop supplying and selling equipment in Russia and has not announced a return to the country since then.
Deputy Anton Gorelkin believes that Apple will comply with the new requirements. He wrote this in a Telegram channel when he refuted claims that legislators are trying to ban Apple devices in Russia.
"We see that the American company is trying to respect Russian legislation. Yes, it discriminates against Russian applications, but only because it also complies with American legislation, which requires removing applications from sanctioned companies from the App Store. And if we create a legal basis for an alternative store to operate in the Russian Federation, Apple will formally have no relation to its content," Anton Gorelkin wrote in the Telegram channel. "We have certain reasons to believe that Apple will comply with its requirements if this bill is adopted."
However, the deputy did not specify what would happen if the company did not agree to the terms of the new bill.
